CLIENT MEASUREMENT FORM

1. Scope

These general terms and conditions of sale (GTC) apply to all orders placed on the NM Class website. By placing an order, the customer unreservedly accepts all of these terms and conditions.

3.1. Products
The products offered for sale are those listed on the NM Class website at the time of consultation by the customer. Each product is accompanied by a detailed description, photos, and a size guide.

3.2. Price
Prices are indicated in Canadian dollars (CAD) for those who are in Canada or American dollars (USD) for those elsewhere, all taxes included (GST and QST). NM Class reserves the right to change its prices at any time, with products being billed based on the rates in effect at the time of order confirmation.

3.3. Delivery fees
Shipping fees are indicated before the order is confirmed and vary depending on the chosen delivery method and the destination.

4. Order

4.1. Order Validation
The order is validated after payment is accepted. A confirmation email is automatically sent to the customer summarizing the order details.

4.2. Product Availability
Product offers are valid as long as they are visible on the website. In case of unavailability after order confirmation, the customer will be informed and may either be refunded or exchange the product.

4.3. Capacity to Contract
By placing an order, the customer declares that they have the legal capacity to enter into a contract and are at least 18 years old.

5. Payment

5.1. Accepted Payment Methods
NM Class accepts the following payment methods :

• Credit cards (Visa, MasterCard, American Express)
• PayPal
• Bank transfer

5.2. Payment Security
All payments are secured through our certified payment service provider. Bank information is never stored on our servers.

5.3. Non-payment
In case of non-payment, NM Class reserves the right to suspend or cancel the order.

6. Delivery

6.1. Delivery Areas
NM Class delivers to Canada, the United States, and several countries in Europe, Africa, and the Middle East.

6.2. Delivery Times
Delivery times are indicated at the time of order and vary depending on the destination and the chosen delivery method. The times are given for information purposes only and may vary.

6.3. Receipt of the order
The customer is required to check the condition of the order upon receipt. In the event of any issue (missing, damaged product, etc.), the customer must submit their complaints in writing within 48 hours of receipt.

6.4. Transfer of risks
The transfer of risks occurs at the moment the package is handed over to the carrier.

7. Right of Withdrawal and Returns

7.1. Withdrawal Period
In accordance with current legislation, the customer has a period of 30 days from the receipt of the product to exercise their right of withdrawal without having to provide reasons or pay any penalties.

7.2. Return Conditions
Products must be returned in their original condition, complete, unworn, unwashed, and with all their tags. Return costs are the responsibility of the customer, except in the case of defective products or an error on our part.

7.3. Refund
The refund is made within a maximum of 14 days following receipt of the return, using the payment method used for the order. The initial shipping costs are not refundable.

7.4. Exclusions
The right of withdrawal does not apply to:

• Personalized or custom-made items
• Underwear and swimwear (for hygiene reasons)
• Items on sale or clearance

8. Warranties

8.1. Legal warranty of conformity
NM Class is liable for any defects in the conformity of the product under the conditions provided by law. The customer benefits from a legal warranty of conformity for a duration of 2 years.

8.2. Warranty for Hidden Defects
In the case of a hidden defect, the client may exercise their recourse in accordance with the applicable legislation.

8.3. Procedure in Case of Defect
In the event of a defective product, the customer must contact customer service at info@nmclass.com by attaching photos of the defect and their order number.

9. Intellectual Property

All elements of the NM Class site (texts, images, logos, videos, etc.) are protected by copyright and intellectual property. Any reproduction, modification, or unauthorized use is prohibited.

10. Protection of Personal Data

10.1. Data Collection
The information collected is necessary for processing orders and managing the customer relationship. In accordance with the law, the customer has the right to access, correct, and object to data concerning them.

10.2. Use of Data
Data is used exclusively for order management, customer service, and marketing operations with the customer's consent.

10.3. Cookies
The site uses cookies to improve the browsing experience and analyze traffic. The client can configure their browser to refuse cookies.

11. Liability

NM Class makes every effort to ensure the accuracy of the information presented on the site. NM Class cannot be held liable in the event of inaccuracy or omission. Product photos are non-contractual.

12. Force Majeure

NM Class cannot be held responsible in case of delay or non-performance due to a case of force majeure (natural disaster, strike, war, etc.).

13. Modification of Terms

NM Class reserves the right to modify these general terms and conditions at any time. The new terms take effect as soon as they are published on the website. Orders placed before the modification remain subject to the terms in effect at the time of the order.

14. Applicable Law and Disputes

14.1. Applicable Law
These terms and conditions are governed by Canadian law and Quebec law.

14.2. Dispute Resolution
In the event of a dispute, an amicable solution will be sought before any legal action. The client can contact our customer service at info@nmclass.com.

14.3. Mediation
In case the claim fails, the client may resort to a mediation procedure.
